By accessing or using Virturo’s platform, you confirm that you have read, understood, and agreed to be legally bound by these Terms & Conditions, along with Virturo’s Privacy Policy, Cookies Policy, and related documents. These Terms & Conditions constitute a legally binding agreement between the user and Virturo.
Introduction
Virturo provides a platform enabling individuals to manage their own investments. All decisions and actions are performed solely by the user ("you"). Virturo does not provide financial advice, manage funds, or act on behalf of users. Virturo is owned and operated by Finastra Ltd, with the following addresses:
Registered Address: Trust Company Complex, Ajeltake Road, Majuro, MH96960, Marshall Islands.
Operating Address: 30 Saint Mary Axe, London, EC3A 8BF.
Eligibility
Users must be at least 18 years old and have the legal capacity to enter into binding agreements. Politically Exposed Persons (PEPs) are prohibited from registering. Virturo does not accept users from jurisdictions where its services are restricted or prohibited. It is the user's responsibility to ensure compliance with local laws before using the platform.
User Responsibilities
Users are responsible for the accuracy of all information provided during registration and for promptly updating their details if circumstances change. Login credentials must be safeguarded to prevent unauthorized access. Any suspected unauthorized use must be reported to Virturo immediately. Users are responsible for ensuring compliance with all applicable laws, including those related to taxation. Virturo’s platform operates on an execution-only basis, meaning all investment decisions are the sole responsibility of the user.
Services Offered
Virturo offers an execution-only platform, where trades are executed based solely on user instructions. Market data is provided for informational purposes only and should not be relied upon without independent verification. Virturo supports fractional share investments, which may not confer voting rights and are non-transferable. The platform adheres to applicable standards under MiFID II and MiCA for transparency and fair treatment.
Fees and Charges
Virturo is transparent about fees, and any applicable costs are outlined in the Fee Schedule available on the platform. Users are responsible for any additional charges imposed by their bank or payment service provider. Virturo itself does not charge withdrawal fees and does not impose hidden charges.
Regulatory Disclosures
Virturo complies with GDPR to protect user data. The platform processes personal information as outlined in the Privacy Policy and retains data only as necessary under regulatory obligations. Users are informed that crypto-assets may not be regulated under the UK Financial Conduct Authority (FCA) and may lack certain consumer protections. Virturo does not accept users from jurisdictions where its services are prohibited or restricted by law.
Risk Acknowledgment
Investing in financial instruments carries inherent risks, including potential loss of the entire investment. Virturo does not guarantee order execution at displayed prices or within specific timeframes due to market volatility, technical disruptions, or other factors. Users should invest only what they can afford to lose and acknowledge the risks before engaging in trading activities.
Data Protection and Privacy
Virturo is committed to protecting user privacy and adheres to GDPR requirements. By using the platform, users consent to the collection and processing of their personal data as outlined in the Privacy Policy. Data is stored securely and retained only as long as necessary to fulfill regulatory and operational requirements.
Tax Compliance
Users are solely responsible for calculating, reporting, and paying applicable taxes on their investments or trading activities. Virturo does not provide tax advice or reporting services. In compliance with legal obligations, Virturo may share user data with tax authorities as required by law.
Prohibited Activities
Users are prohibited from engaging in activities such as unauthorized automated trading, market abuse, insider trading, scalping, and exploiting platform vulnerabilities. Accounts engaged in prohibited activities may be suspended or terminated.
Complaints and Dispute Resolution
Complaints must be submitted through Virturo’s support channels, and the platform will acknowledge and address them within 14 business days. If disputes cannot be resolved through customer support, they may be referred to arbitration under the laws of the Marshall Islands.
Amendments to Terms
Virturo reserves the right to amend these Terms & Conditions at any time. Users will be notified of changes via email or platform notifications, with at least 30 days' notice when practicable. Continued use of the platform after amendments constitutes acceptance of the updated terms.
Force Majeure
Virturo is not liable for service disruptions caused by events beyond its control, such as natural disasters, cyberattacks, regulatory changes, or market suspensions. These events may impact the availability and functionality of the platform.
Governing Law and Jurisdiction
These Terms & Conditions are governed by the laws of the Marshall Islands. Disputes arising from these terms will be resolved exclusively by the courts of the Marshall Islands.
Declarations and Final Agreement
By registering with Virturo, users declare that they are not classified as PEPs, do not reside in restricted jurisdictions, and meet all eligibility criteria. Users also confirm that they have read, understood, and agreed to these Terms & Conditions and related policies. Virturo is not responsible for the outcomes of user-made investment decisions.
Delete My Account
In compliance with GDPR, users have the right to request the deletion of their account and associated personal data. To delete your account, please follow these steps:
- Ensure all open trades are closed and your account balance is withdrawn.
- Contact Virturo Support at support@virturo.com with the subject line "Delete My Account" and include your registered email address and account ID for verification.
- Once your request is received, Virturo will verify your identity and process the deletion within 30 days, unless legal or regulatory obligations require data retention.
- You will receive a confirmation email once the account deletion is completed.
